SERIOUSLY SCILLY BOOKING CONDITIONS 2018/9
BOOKINGS ARE ACCEPTED ON THE FOLLOWING CONDITIONS:
The contract of letting is between the guest ("the guest") and the Owners, Phil & Sarah Spence.
The Owners accept no responsibility for personal injury to the guest and /or his/her invitees (jointly known as the Holidaymakers), or loss of or consequential loss or damage to their property, or for other matters over which the owner has no control
This agreement is made on the basis that the property ("the property") is to be occupied by the Holidaymakers for a holiday as mentioned in the Housing Act 1988 Schedule 1 paragraph 9. The Holidaymakers acknowledge that the tenancy granted by this agreement is not an assured tenancy and that no statutory periodic tenancy will arise when it ends.
Bookings cannot be accepted from persons under 18 years of age.
Group bookings of single sex parties are not permitted unless special arrangements have been made by the Holidaymakers and the Owners.
The Holidaymakers shall keep the property and all the furniture, fixtures and fittings in or on the property in the same state as at the commencement of the holiday, and shall leave the property in the same state of cleanliness and general order in which it was found.
The Holidaymakers must report and pay to The Owners the cost of any damage or breakages made during their holiday occupancy.
The Owners reserve the right to make a charge where guests have contravened The Owners request for their property to be smoke free.
(In order to comply with the Unfair Terms in Consumer Contracts Regulations 1999, the amount of such a charge should not be more than the cost of cleaning the property, in this instance £300)
The Holidaymakers right to occupy the Property may be forfeited without compensation if :
More people or pets than declared at the time of booking, or before commencement of the holiday to The Owners, attempt to take up occupation.
Overnight guests are entertained without The Owners express permission.
Any activity is undertaken which is illegal, or may cause unreasonable damage, noise, behaviour or disturbance.
Smoking in any of our properties.
All prices quoted include VAT where applicable at the current rates.
In the event of there being cause for complaint concerning a property, the matter shall be taken up with The Owners at once.
It is important that this is done whilst you are still at the property so that an on the spot investigation can be made if necessary and remedial action taken if required.
In no circumstances will compensation be considered for complaints raised after the holiday has ended when the Holidaymakers have denied The Owners the opportunity of investigating the complaint and endeavouring to remedy matters during the holiday.
The Owners or their representative shall be allowed access to the Property at any reasonable time during any holiday occupancy.
ADDITIONAL IMPORTANT INFORMATION TO BE CONSIDERED
The prices shown on site are per property per week running from Saturday to Saturday in The Victory, Friday to Friday in Firmans Cottage and Thursday to Thursday in The Nook.
DEPOSIT & HOLIDAY INSURANCE
A non-refundable deposit representing 30% of the total cost plus holiday insurance is required to secure your booking. Please ensure that your chosen policy covers all forms of travel delay, including adverse weather conditions in the UK.
Provisional reservations or requests to hold dates will be re-let after 48 hours if the duly signed agreement and deposit has not been received - or we do not hear further. Payment are required via card payment or paypal through our invoice system or bank transfer - we do not accept cheques.
The full balance for your holiday is due 6 weeks prior to your arrival date. In the event that the balance is not paid within 14 days of due date, cancellation will be assumed with consequent loss of any deposit received.
ARRIVALS AND DEPARTURES
All properties are available from 14.00 on the day of arrival and must be vacated by 10.00 on the day of departure. It would be appreciated if you do not arrive early, as time is required to thoroughly clean the cottages between lets.
LINEN AND TOWELS
All bed linen & towels are provided. (Please bring your own beach towels).
HOT TUB - THE NOOK
The Hot tub at The Nook requires continual maintenance and cleaning - it may be unavailable for use for certain periods during your stay. In times of water shortage on the island, the hot tub will be unavailable.
PETS AND SMOKING
We welcome up to 2 small dogs in our holiday cottage The Victory (at a standard extra cost) and breed of dog must be declared at time of booking.
Holidaymakers wishing to take a dog(s) on holiday must abide by the following rules :
Dogs must be under strict control at all times while in and around the property
Any fouling of lawns etc. must be cleared up without delay.
The dog owner must either bring their dog's bed/basket with them or request one when booking.
Dogs MUST NOT be left alone in the property or elsewhere at any time.
Dogs MUST NOT lie on beds or furnishings and hair must be well cleared up before departing and windows left open for airing.
Dog owners must ensure that their pets are free from parasites and fleas before they occupy the property. Failure to do so will incur substantial subsequent charges.
Young pets i.e. puppies, MUST be declared and authorised by the Owners. If a puppy or young pet is taken to the property without consent of the Owners, this could result in you being asked to leave without compensation.
Dogs must not be allowed on the furniture/beds at any time. If this is not adhered to we reserve the right to charge the holidaymakers a deep cleaning and fumigation cost of £300 taken on departure.
Smoking is strictly forbidden in all properties. However, no restriction is made in the garden area.
In the event of cancellation with less than 12 weeks notice, the full cost of your holiday will be payable unless we are able to let or part let the cancelled period, in which case a proportional refund will be made at the end of the cancelled period.
It is an express condition of your booking that in the event of cancellation, or the duration of the booking is changed in any way, the transfer of the booking to another party, or subletting of the property is forbidden. We have a long waiting list of customers who will then be contacted to take the newly available dates.
We would like all guests to consider that although we live adjacent to the properties, this is our family home and consideration should be taken to this. Phil & Sarah are contactable by telephone/text & email during office hours and outside of these times, please only call in times of Emergency.
These Booking conditions apply to all confirmed bookings.
